Legislative Decree 44/20: Transposition of the European Directive on carcinogens

The Legislative Decree 44 of 01 June 2020 was published in the Official Journal of 09.06.2020 as transposition of a European directive of 2017.
This results in changes to Title IX - Chapter II of Legislative Decree 81/08 relating to carcinogens or mutagens.
In particular, this decree, which comes into force on 24 June 2020, modifies Annex XLII of Legislative Decree 81/08, including works involving exposure to respirable crystalline silica dust generated by a manufacturing process (which therefore becomes classified as a carcinogen).
This change mainly affects the sectors: construction (construction companies, earthmoving activities), marble processing, quarries.
Legislative Decree 44/20 also modifies Annex XLIII of Legislative Decree 81/08, where some occupational exposure limit values are added and some are modified. In particular, the limit value for hardwood dusts goes from 5 mg / m3 to 3 mg / m3 until 17 January 2023. This value will further decrease to 2 mg / m3 starting from 18 January 2023.
This change mainly affects the woodworking and carpentry sectors.
Companies that have workers exposed to this type of risk will therefore have to provide for:
- carrying out periodic environmental investigations
- drafting risk assessment of carcinogens
- preparation of the register of exposed carcinogens and sending to INAIL
- training for workers exposed to the risk of carcinogens
Non-repayable contribution up to 65% of admitted expenses, up to a maximum of € 130,000 of contribution.
